It also allows the public and consulting parties to participate in the National Historic Preservation Act Section 106 process by providing comments directly to the Navy.
REFERENCE AUTHORITY
Programmatic Agreement (PA) Among the Department of Defense, the Advisory Council on Historic Preservation, the Guam State Historic Preservation Officer (SHPO), and the Commonwealth of the Northern Mariana Islands (CNMI) State Historic Preservation Officer regarding the Military Relocation to the Islands of Guam and Tinian (March 2011).
APPLICABILITY
Per Stipulation I.A., the PA applies to all individual projects associated with the Guam and CNMI Military Relocation, as identified in the Final Environmental Impact Statement (FEIS) and listed in Appendix A and as added or modified pursuant to Stipulation I.E. These projects are collectively referred to as the "Undertaking," per the definition of that term in 36 CFR 800.16(y).
Stipulation I.E. states that if the DoD proposes new actions or projects on Guam or Tinian that support the Undertaking but are not listed in Appendix E of the PA, such actions will require supplemental review.
PROJECTS ON THE PRESIDENTIAL BUDGET TO CONGRESS
Under Stipulation IV.E.1., beginning in 2011, within 30 days of the formal submission of the Presidential Budget to Congress, the DoD will provide information about military construction projects anticipated for the following fiscal year.
GENERAL REQUIREMENTS FOR PROJECTS
As part of each year’s annual review of projects, Stipulation IV.E. of the PA states that the DoD will seek additional information from the Signatories, Invited Signatories, Concurring Parties, and the public regarding historic properties in the project areas associated with the Undertaking, prior to finalizing determinations of eligibility, consistent with 36 CFR 800.4(a)(3) and 800.4(b)(1).
Stipulation V.B.1. requires the DoD to post to the CRI website PA Memos for public comment for projects proposed for that fiscal year prior to the DoD's authorization of ground-disturbing activities or other actions with the potential to adversely affect historic properties.
